City of Sydney
Residents can make submissions to City of Sydney at any time right up until a DA is determined. To ensure full consideration by the assigned council assessment planner, iObject prescribes an additional two to three-week ‘Informal Deadline’, depending on the scale of the project in question.
If there is insufficient time to produce a detailed submission within Council’s notification period, we recommend seeking a deadline extension directly from the council officer, which iObject can negotiate on your behalf.
Submissions must address planning law considerations rather than general opposition.
Experience Highlight: MOORE PARK
S4.55 (8) Modification lodged with the Land and Environment Court to delete condition 44 which requires a building upgrade under the BCA.
Address: No. 382 Moore Park Road, Paddington, NSW
Application: D/2021/653/A
Services Provided: DA Deficiency Audit, Principal Objection and Land & Environment Court Representation
Impact Risks
Inadequate protective measures as a re-classification of the building would degrade the level of safety and amenity provided in the original DA approval.
Each room had cooking facilities including an electric stove top further increasing the fire safety hazard between rooms.
The expansion of the boarding house to a 16 person capacity would result in larger gatherings and/or greater utility unit noise, meaning increased noise levels at most hours of the day.
Determination: Council sided with iObject's arguments surrounding fire safety and re-classification concerns. Council echoed our position and officially refused the proposal. However, this refusal was challenged in the Land & Environment Court which resulted in an amended approval with protections for surrounding properties.
What iObject Achieved
iObject's Principal Objection and advocacy before the Court ensured the results achieved at the development application stage were defended. Our pressure ensured that most of the conditions were maintained and that a fire safety plan was put in place.
